|
What do you have to do to sign over an animal?
A Dog/Cat Surrender Ticket and a personality profile sheet is filled out on the animal. The fee to surrender a dog for adoption or to be put to sleep is $25, and a dog for cremation is $15. If you want an Animal Control Officer to pick up your dog at your house, the surrender fee is $45. To surrender a cat to be put to sleep or cremated is $10. To pick up an owner's deceased animal is $45.
|
What happens when you sign over a dog?
When a owner signs over their dog, the Shelter holds the dog for up to seven days giving the surrendering party time to change their mind. While the dog is here, prospective adopters leave their names and phone number and are given an adoption date and time to come in to finalize the adoption paperwork. If the dog is not adopted or redeemed from the Shelter, the dog will be put to sleep. When a stray dog is picked up and brought to the Shelter by the public, the procedure is the same as for an owner’s dog, but there is no charge. If the Animal Control Officer picks up a stray dog, it is held for seven days. If the stray dog is not adopted or redeemed, it will be put to sleep. If the stray dog has identification, we will notify the owner by telephone, if possible, and also send certified mail.
What is the purpose of a NYS dog license? Why do I need one?
NY State requires every dog over the age of 6 months to be licensed. A license tag on a dog’s neck is a form of identification and helps in finding your dog if the dog ever gets lost.
Why do we spay/neuter a dog when we adopt?
The Town of Brookhaven requires that every dog/cat leaving the animal shelter be spayed or neutered to help control the stray dog/cat population.
What is the appearance ticket for?
Appearance tickets are issued for violations against Chapter 23 of the Town of Brookhaven code, e.g. dog running at large, unlicensed dog, and unidentified dog (not wearing tag). The issuance of these tickets will assist in preventing dog owners from letting their dog run at large.
Do a lot of dogs/cats get adopted from the Shelter?
At least 50% of all dogs get adopted or redeemed, cats approximately 40%.
How long do you keep the dogs/cats if they are not adopted?
The Shelter holds these animals for as long as possible depending on the overcrowding conditions existing as the Shelter at the time.
How do I look for my lost dog?
If you have lost your pet, you must come to the shelter yourself, to identify your dog. Shelter employees cannot identify your dog, only you can do that. If your dog is licensed, bring proof of licensing and rabies when you come to redeem your dog. Also, contact your local vet or other animal shelters.
What can I do about a vicious/dangerous dog in my area?
If you or a family member has been threatened by an aggressive dog you should call the shelter and ask that an Animal Control Officer be sent to take an report and advise you on the procedure for taking the dog owner to court on a dangerous dog complaint. The officer will either apprehend the dog or advise the dog owner of the penalties that he may be subject to.
|
What do I do if someone’s dog bites me?
The responding officer takes a report from the dog bite victims with all necessary information about the incident and that report is kept at the Shelter for use by the Suffolk County Health Dept. And/or Brookhaven Town Attorneys Office if the biting victim wants to process a Dangerous Dog Proceeding with the court.
How many dogs are people allowed to own?
Residents of the Town of Brookhaven are permitted to harbor ten (10) dogs.
Who can I complain to regarding a barking dog?
Barking dog complaints can be made to the Town’s Noise Control Department by calling 286-1813.
|
What is your adoption policy?
Residents of the Town of Brookhaven have first preference, but non-residents may also adopt. All dogs adopted receive bordatella and a 4 in 1 vaccine, cats receive a 3 in 1, all animals are spayed/neutered, licensed, and given a rabies inoculation before leaving the shelter.
What zone is my property in?
We do not have zoning maps in this department. You must go to the Planning Department for that information.
|
Do I need a variance to build on my property?
The Building Department determines whether you will need a variance or not. If you apply for a building permit with the Building Dept. and you are not meeting the requirements of the Town building and zoning codes, the Building Dept. will deny your permit and send you to the Board of Zoning Appeals for a variance.
|
Can I subdivide my property?
There is no simple “yes” or “no” answer to this question. A formal application must be filed and heard by the Board at a public hearing. The Board takes into consideration many factors when deciding to approve or deny a land division application, including but not limited to, conformity to the surrounding area and impact to the environment.
How long does it take to get a variance?
From the time you file an application it will be approximately 2 months before, your case is heard by the Board at a public hearing.
When is a change of use application required?
A change of use application must be filed under the following circumstances:
Change from one use on a Certificate of Occupancy to a different use.
Modification to façade of building.
Modification to parking lot.
Modification to landscaping or grounds.
Commercial additions under five hundred square feet.
Commercial addition of over five hundred square feet (also needs site plan approval)
Day care or nursery school use. (also needs site plan approval).
|
Where do I get an application?
You receive an application at the Town of Brookhaven Planning Division at Town Hall in Farmingville.
Once I obtain a determination on my application am I through?
No. You may need to go through a site plan process and you will need to obtain a Building Permit and Certificate of Occupancy for the new use.
What are clearing restrictions on property?
Clearing restrictions are placed on a property when a decision is rendered by the Planning Board, the Town Board, or the Board of Zoning Appeals. Clearing restrictions limit the total amount of vegetation clearing allowed on a property.
Does a clearing limit only apply to trees?
No. Clearing limits apply to trees, shrubs and soil disturbance. This means you cannot remove or disturb any of these features on your property if it is subject to these restrictions.
|
Am I allowed to remove trees from my property?
A tree clearing permit is required under the following circumstances:
a. If your property was part of a residential subdivision, land division or Board of Zoning Appeals decision, which placed clearing restrictions on the property as part of the approval.
b. If your property is greater or equal to two acres in size.
Note: If you are in doubt please call the Planning Division. |
Am I allowed to remove vines, shrub, weeds and/or grading of my property?
If your property was part of a residential subdivision, land division or Board of Zoning Appeals decision there may be clearing restrictions or buffers restrictions on your property. If you are in doubt please call the Planning Division.
Can I receive relief of a Planning Board covenant that was placed on my property and what will it cost?
There is a formal procedure in place for this request. You may download these forms. The cost is two hundred dollars ($200.00) for lots in conformance with existing covenants and $500.00 for lots in violation of existing covenant.
|
What is the difference between a buffer and a clearing restriction?
A buffer is a particular width of natural vegetation that lessens or absorbs the shock of developmental impacts. A clearing restriction establishes a percentage of the total lot area that can be cleared of its natural vegetation.
|
What is a covenant?
A covenant is a mutual agreement by two or more parties restricting the usage of a portion of the property from development including clearing, construction of fences or any other physical disturbance. The covenant transfers with the land and is independent of ownership.
Can I remove poison ivy from my property if I have a buffer or clearing restrictions?
If you have buffer or clearing limits imposed on your property it will be necessary to receive relief from the agency, which imposed those limits.
If I over cleared my property what do I do now?
Contact the Planning Division and provide a revegatation plan to replace the damaged areas.
Can I put a swimming pool, shed. Swing set or any other accessory structures in a buffer?
No.
Can I clear more trees than my builder did?
It depends on your clearing limits and/or buffer requirements. Check your as- built survey for this information. If in doubt call the Planning Division.
What is a Community Development Block Grant (CDBG)?
| The United States Department of Housing and Urban Development issues a specified amount of money to be filtered down to local communities and used for the express purpose of addressing neighborhood beautification, revitalization and general quality-of-life issues. This money is reserved for neighborhoods that are found to be in a lower to moderate income classification, as is identified by the Census. | |
How does my community go about getting these funds?
In late October or early November we hold an Annual Public Hearing at which time residents and members of civic and other organizations have an opportunity to present their requests to the Brookhaven Town Board for Community Development Block Grant funds. Again, as with most of our programs, these projects must fall within census tract authorized areas. Each request is reviewed by the board following the hearing and decisions are then made as to how the funding will be allocated.
What does the Division of Environmental Protection (DEP) do?
The Division of Environmental Protection undertakes a shellfish management program, runs educational programs at the Mount Sinai Nature Center, reviews projects before the Town of Brookhaven Town Board and Planning Board concerning matters affecting the environment and other natural resources of the town, and insures compliance with the State Environmental Quality Review Act. Additionally, the Division is the entry point for Chapter 81 Wetlands and Waterways Wetland and Coast Erosion and Hazard Area permit applications. The Division is also involved in Coastal Management issues and open space land acquisition.
What impact do ATVs have on public lands?
The Long Island Central Pine Barrens Preserve is intended to protect the areas natural resources and underlying drinking water aquifer. All-terrain vehicles (ATVs) have become a very serious threat to the Preserve and other natural areas.
* There are many sensitive habitats (e.g. coastal plain pond shorelines) in the Pine Barrens containing rare species of plants and animals that are being degraded or destroyed by ATVs.
* Noise, dust, and fumes from ATVs are not only unhealthy but are very stressful to wildlife, and can also spoil an outdoor experience for other users of public land.
* Erosion caused by ATVs ruins hiking and mountain biking trails as well as fragments and degrades natural ecosystems.
* The U.S. Consumer Product Safety Commission estimates that there have been over 4,541 ATV-related deaths since 1985. The American Association of Orthopedic Surgeons considers ATVs to be a significant health risk. In 2001, the number of ATV-related injuries requiring emergency room services was 111,700. The majority of injuries were cranial or spinal and had severe consequences.
* ATVs ARE ILLEGAL ON ALL PUBLIC LAND IN SUFFOLK COUNTY. They are only legal on private land that is zoned for such an activity and with the owner(s) written permission.
* Penalties for illegal use of ATVs include fines of up to $5,000.00 and impoundment or forfeiture of the vehicle.
* You can help public land managers and law enforcement officials protect the Pine Barrens by watching for illegal activities such as dumping and ATV use, and by calling 1-877-BARRENS (1-877-227-7367) to anonymously report violations.
* You can also help by educating your children, your neighbors, your friends, your political representatives, the news media and others about the dangers of ATVs and the damage they cause to our environment. |

Besides the annual operating permits, what other permits are required?
A permit from Fire Prevention is required to erect, alter or add to any building other than a single-family dwelling. This includes any changes that are strictly interior but which might affect the exit facilities. No permit is required for painting, redecorating, etc. There is no fee for such permits. Permits are also required for the installation of tanks and containers holding combustible/flammable liquids or gases, as well as the installation of fire alarm systems, sprinkler systems, hood & duct systems and fixed extinguishing systems (found in commercial cooking establishments and gasoline stations). Fees are required for the installation of systems and containers. |
Do we need a permit and subsequent Certificate from both Fire Prevention and the Building Division to erect or alter “commercial” buildings?
Yes.
What must be submitted to obtain a permit to erect, alter or add to a building and how long does it take to get the permit?
A simple, one page (actually ½ page) application (no copies are necessary), and two sets of plans. In accordance with NYS Education Law, for all new construction and additions as well as for any Change of Use, or any change involving life safety, at least one set of the plans must bear the original seal and signature of a NYS licensed design professional (architect or engineer). Any alterations that involve anything of a structural nature must also include a signed & sealed set of plans. If an alteration involves only non-structural work, such as moving or adding partitions or new display racks, then “contractor” prepared plans, drawn to scale and listing all the pertinent information, such as type of finish on the walls and what they are built of, are acceptable. If the permit is for new construction or additions, then we must have an approved site plan on file. After submission of the application and plans, the review will take approximately one week or less. Depending on the complexity of the project, as well as the overall workload of the Division, it may take two to three weeks to receive the permit.
Besides the fee and application, what must be submitted to obtain a permit for a sprinkler or fire alarm system, or for a hood & duct or fixed extinguishing system?
Just as for new construction, in accordance with NYS Education Law, at least one set of the plans must bear the original seal and signature of a NYS licensed design professional (architect or engineer).
What are “Additional Requirements”?
Virtually every permit will have a list of Additional Requirements. This lists any requirements that were not covered in the submitted plans, as well as some standard “boiler plate” requirements, such as safety during construction, demolition, excavation and so on. It is absolutely vital that you read, understand and comply with all the “Additional Requirements”. It is also just as vital that you pass these “Additional Requirements” along to every contractor and sub contractor involved in the job! If there are differences of opinion, need for interpretation, possible alternatives or any question whatsoever regarding the Additional Requirements, they are readily handled early on. If you don’t read the Additional Requirements, you almost assuredly will experience unpleasant surprises, delays in opening and avoidable, unplanned-for, added expense!
After a permit is issued for a new, added or altered building, when does Fire Prevention inspect?
When all the work is completed, call the office at (631) 451-6262 and ask to schedule a final inspection. Do not ask for the Fire Marshal who issued your permit, since he most likely will not be the Marshal to do the inspection! Doing so will only delay your request. If the project is particularly large, or if there is need for clarification, we will be happy to conduct a preliminary inspection. Generally, it takes two to three weeks after you call to have the final inspection. Hence, try to make the request slightly ahead of your scheduled completion date. It’s always better to have an appointment, then maybe have to call up the day before and cancel it, rather than wait those few weeks after you actually finish the job. “Time is money!” After the final inspection and correction of any deficiencies, the Division will issue a Certificate of Compliance and, if appropriate, a memo to the Chief Building Inspector, indicating that Fire Prevention has no problem with the job.
If I can’t get everything finished but I have significantly completed the work and am desperate to open, may I get a “temporary” okay to open?
If the work is substantially complete and a Fire Marshal has inspected the job and finds no life safety concerns, the Chief Fire Marshal may inform the Chief Building Inspector that we have no objection to the temporary use of the premise. However, only the Chief Building Inspector can actually authorize the occupancy or use of any building, either temporarily or permanently.
Is there any way to speed up either the Permit Review or Inspection process?
“Time is money”. There are times when our estimated time frames for permits or inspections become extended. Similarly, there are times when you must start construction or operation as soon as possible. Should either situation arise, you can request an Accelerated Plans Review or an Accelerated Inspection. This involves completing a request for the action, which is then assigned to a Fire Marshal to conduct on an overtime basis. You then are required to pay the overtime expenses incurred. This expense varies, depending upon the Fire Marshal assigned and the complexity (time involved) to complete the task. Generally, the fee starts at approximately $185.00. If the job is particularly large, more than one Fire Marshal will be assigned. Remember, this fee must be paid, regardless of whether or not the permit is issued or the Certificate of Compliance is issued. Failure to pay the fee in a timely fashion will result in revocation of permits and./or Certificates of Compliance as well as other litigation deemed appropriate.
How do I get a copy of an Incident Report if I suffered a fire?
A simple request, in writing, to the Chief Fire Marshal is all that is needed. Depending on the severity of the fire, as well as the overall workload of the Division, it can take from several days to several months for the report to be completed. As soon as it is finalized, your request is honored. There is no fee for this report.
Can anyone get a copy of an Incident Report for a fire in my home?
While Incident Reports are substantially matters of public record, we do take precautions to protect the privacy of individual homeowners/occupants. Some entities are legally entitled to the Incident Report without question: other Town agencies, Law Enforcement agencies, insurance companies and their private investigators, as well as contractors, owners, workers or others who may be involved in or affected by the fire, and those who obtain subpoenas or court orders. If the relationship of the requestor to the persons involved in the fire cannot be easily established, before releasing the report, we will ask for a clarification.
|
Can I get a history of violations at any business, maybe because I’m interested in buying it or doing some other related work?
Submit a Freedom Of Information Law request to our office (faxes are acceptable). Many companies have pre-printed/computer generated forms requesting such information. These company provided forms are acceptable by themselves: they do not also need a formal, Town-provided FOIL request. Please bear in mind that you must include a street address. All of our records are kept by street address, not tax item number, section, block & lot, or distance from intersecting streets. Now, the bad news is this: sometimes we are absolutely overwhelmed with work. When that occurs, we have no alternative but to prioritize the work and unfortunately FOIL requests go to the bottom of the list. If needed, we will be happy to provide you with an acknowledgement of your request and an estimated time of reply, but the unfortunate fact is that sometimes it can take as much as a month (or more) to process the request.
|

What Codes apply to premises in the Town of Brookhaven?
The New York State Uniform Fire Prevention and Building Code (known as the “Uniform Code”), the codes and standards of the National Fire Protection Association (known as the “NFPA”) and Chapter 30 of the Code of the Town of Brookhaven (known as the “Fire Prevention Local Law”) are the codes used in Brookhaven Town. Sometime in the second half of 2002, New York State will likely have adopted a new Uniform Code that substantially incorporates the International Family of Codes (International Fire Code, International Building Code, International Property Maintenance Code, International Mechanical Code, International Energy Conservation Code, etc.), with enhancements for New York State.

Who determines if a ball field is playable or not?
The goal of the Town of Brookhaven Parks Department is to keep ball fields in the best shape and as safe as possible. Overuse and playing on wet fields can cause damage which result in costly repairs and long recovery times (closing fields). The Parks Dept Grounds Crews will inspect fields and will determine if a field is playable. If it rains immediately before a game, game officials or Parks personnel will determine whether to call a game.
When are the ball fields cut and lined?
Fields are serviced by area Parks Crews on a regular maintenance schedule. The fields are typically mowed when the grass is between 3”-4.5” tall. Once cut, the fields will be lined. Parks will try and line the fields before a day of games and in-between if crews are available. The maintenance schedule is affected by weather and demands at parks where specific attention is needed such as park safety related issues or priority work orders.
