Welcome to the Brookhaven Town Clerk's Office--- a people-oriented and busy department, serving the needs of our taxpayers.

Now available for you on the Town Website are the many activities and licenses available through the Town Clerk's offices.  Through this online service, we have provided our residents with information on obtaining New York State licenses, permits, as well as important records and an array of Town licenses and permits.

TOWN CLERK FUNCTIONS
The Town Clerk’s Office keeps an accurate record of the proceedings of the Brookhaven Town Board meetings. We are also responsible for keeping an accurate record of all Town ordinances and resolutions; attests, publishes, and preserves an accurate record of all Town ordinances and resolutions; is the custodian of the Town Seal; maintains files of Town contracts, agreements, and licenses; and administers oaths, affirmations and acknowledgments.

The Town Clerk's Office seeks to provide the best possible service to our customers. We strive to provide information and hearing notices to Town staff, other public agencies, and the public; legislative support to the Supervisor and Town Council; election coordinator for Primary and General Elections; source for voter registration forms and absentee ballot applications and offers records management services to Town staff accurately, promptly, efficiently, and in a friendly and helpful manner. We seek to make every contact with our customers a positive and rewarding one and to be sensitive and responsive to their needs.

CUSTODIAN OF RECORDS
As Custodian of all Town Records, the Town Clerk is responsible for active files, storage and disposition of inactive records and the careful maintenance of archival material.

Local Government Records Law, Article 57-A, states that a local “government body shall promote and support a program for the orderly and efficient management of records.”  Such programs provide several advantages for local government.  They save government resources and taxpayers’ money.  They ensure systematic arrangement of files leading to quick access and retrieval, thus minimizing costly staff time.  The programs lead to better use of space, identification of records having administrative, legal and fiscal importance, and preservation and systematic management of records with permanent value.

GRANTS
As the proportions of the Town of Brookhaven have expanded throughout the years, the population has as well.  As more and more people settled into the Town of Brookhaven, the births, deaths and marriages augmented into large volumes of vital registries.   These records of enduring value (archival records) were worthy of permanent retention and special management because of the importance of the information they contained for historical purposes.  These specific vital records were classified, as having “intrinsic value” for these documents possessed beyond the information they contained.  Therefore, the Town of Brookhaven began its Vital Statistic Registries Project with the assistance of a 1997-1998 Local Government Records Management Improvement Fund (“LGRMIF”) Grant.  This grant set up Phase I of the Vital Statistic Registries Project.  The Town was able to preserve these historical and valuable registries by microfilming birth, death and marriage certificates from the first recorded document in 1847 through 1953. 

As long as the population was multiplying, the vital statistics swelled into great dimensions.  The sizes of the registry books (birth, death and marriages) were converted to hold 1,500 records per book, doubling the previous 750 per volume count.  This ascent was so overwhelming, and the Town of Brookhaven was in dire need of storage space, that ten years later (commencing in 1964) the Town of Brookhaven called upon the Villages within its Township to handle the birth and death certificates inside their respective jurisdictions.  Before this was implemented, the Town of Brookhaven housed the records for four (4) hospitals -cutting the volume of vital documents coming into the Township.  However, the Town remained the sole issuer of Marriage Licenses and remained inundated from its two (2) remaining hospitals, Brookhaven Memorial Hospital and the State University at Stony Brook Medical Center

NEW YORK STATE LICENSES

BINGO - GAMES OF CHANCE - RAFFLE TICKET OPERATIONS
The New York State Racing and Wagering Board mandate guidelines for the issuance of Bingo licenses. A New York State Identification Number issued from the New York State Racing and Wagering Board is required in order to file an application to conduct Bingo games.  The completed application form must include the schedule of game dates. The fee for each individual game date is $18.75, per occasion. A Commercial Lessor cannot hold more than 3 Bingo occasions per day.  The Town of Brookhaven is responsible for administration and inspections.

The guidelines for the issuance of Games of Chance license are mandated by New York State. DOG LICENSES
The owner of any dog six months of age or older shall immediately make application for a dog license. The owner of any dog reaching the age of six months shall thereupon make such application. No license shall be required for any dog which is under the age of six months and which is not at large. A license shall be renewed after a period of one-year beginning with the first day of the month following the date of issuance and shall be renewable annually thereafter prior to the expiration date.

The application shall state the sex, actual or approximate age, breed, color, and official identification number of the dog, and other identification marks, if any, and the name, address, telephone number, county and town, city or village of residence of the owner.

The license fee and a certificate of rabies vaccination shall accompany the application.  In the case of a spayed or neutered dog, every application shall also be accompanied by a certificate signed by a licensed veterinarian showing that the dog has been spayed or neutered. In lieu of the spay or neuter certificate an owner may present a statement certified by a licensed veterinarian stating that he has examined the dog and found that because of old age or other reason, the life of the dog would be endangered by spaying or neutering. In such case, the license fee for the dog shall be the same as for a spayed or neutered dog.

Upon validation by the clerk, the application shall become a license for the dog described therein. Once an application has been validated, no refund therefore shall be made.

PUREBRED LICENSES
The owner of one or more purebred dogs registered by a recognized registry association may annually make an application for a purebred license.  A purebred license shall be valid for a period of one-year beginning with the first day of the month following the date of issuance and shall be renewable annually thereafter prior to the expiration date.

The application shall state the name, address and telephone number of the owner; the county and city, town or village where such dogs are harbored; the sex, breed, registry name and number of each purebred registered dog over the age of six months which is harbored on the premises; and the sex and breed of each purebred dog over the age of six months which is harbored on the premises and which is eligible for registration. The application shall also include a statement by the owner that all purebred dogs over the age of six months, which are harbored on the premises, have been listed.
The license fee and a certificate of rabies vaccination or statement in lieu shall accompany the application thereof.  Upon receipt of the foregoing items, the clerk or authorized dog control officer shall assign a license number, which shall be reserved for the sole use of the named owner, and shall issue a purebred license. Once a purebred license has been issued, no refund therefore shall be made.

FEES for DOG/PUREBRED LICENSES
The annual fee for each dog license is:

$2.50 for each spayed or neutered dog
$15.50 for each unspayed or unneutered dog.

The annual fee for each purebred license is:

$25.00, if no more than ten registered purebred dogs or purebred dogs eligible for registration over the age of six months are harbored on the owner's premises at the time of the application

$50.00, if no more than twenty-five registered purebred dogs or purebred dogs eligible for registration over the age of six months are harbored on the premises at the time of application plus a $3.00 spay/neuter fee for each unaltered dog.

$100.00, if more than twenty-five registered purebred dogs or purebred dogs eligible for registration over the age of six months are harbored on the premise at the time of application.

There shall be no fee for any license issued for any guide dog, hearing dog, service dog, war dog, working search dog or police work dog. Each copy of any license for such dogs shall be conspicuously marked "Guide Dog," "Hearing Dog," "Service Dog," “Working Search Dog,” "War Dog," or "Police Work Dog" as may be appropriate, by the clerk or authorized dog control officer.  Guidelines for the issuance of Dog licenses are mandated by New York State. Renewal applications are sent directly to owners from Albany.

POOCH PASS
The owner of a dog wishing to use the Brookhaven Dog Park must obtain a Pooch Pass. Pass will be valid from May 1 to April 30. Handlers must clean up after their pet. Dogs with a known history of dangerous behavior and female dogs in heat are prohibited. Dogs must have current vaccinations and licenses. Dogs must be wearing a collar with New York State Dog License provided through registry with the Town Clerk’s Office. Puppies under four (4) months old prohibited. Dogs must be spayed or neutered. Leaving dogs unattended is prohibited. Handlers must carry a leash at all times. Limit two (2) dogs per person per visit. Dogs must be leashed prior to entering and upon leaving area. Dog owners and dogs must stay within the designated park area. Dog must be removed from the park at the first sign of aggression. No children under the age of 12 allowed in offleash area. No food, drink, or smoking allowed. No choke or prong collars allowed. Dog owners must be at least 18 years old. Owners and/or handlers are responsible for their dog’s actions. You must pick up after your dog and place excrement in receptacles by each gate. Any dogs outside this area must be on a leash (six foot long maximum). GOING OUT OF BUSINESS
Application must be filed at least 15 days PRIOR to date of sale.  A complete inventory list of merchandise must accompany application.  License is valid for 30 days.

Renewal permit must be obtained not more than 10 days PRIOR to end of the license date.  ONLY ONE (1) RENEWAL PERMIT CAN BE OBTAINED.  Renewal permit is valid for 30 days.  A revised inventory list, of merchandise remaining, must be presented at time of renewal.
Fee: $500.00   Renewal fee: $50.00

HANDICAP PARKING PERMITS
If you are a resident of the Town of Brookhaven, you can obtain an application for a temporary or permanent handicapped parking permit from the Town Clerk’s Office at Town Hall, One Independence Hill in Farmingville.  However, the Town Clerk's office administers this permit directly. Persons living within the incorporated villages of Patchogue, Port Jefferson and Bellport must obtain the application and their permit at their Village Hall.

NEW PERMITS
Part I of the application is to be filled out and signed by the applicant where indicated.  The application must be taken to your physician (MD, DO or DPM - NO CHIROPRACTORS, NURSE PRACTITIONERS OR PHYSICIANS ASSISTANTS) who must fill out Part II completely, including his or her professional license number.  If you have already obtained a prescription note from your doctor, be sure the diagnosis, length of time the permit is needed for, and the professional license number is included.

RENEWAL PERMITS
If renewing a permanent (blue) permit, the expiring permit must be returned with the application.  If your permit has expired for more than a year, follow the instructions above for new permits.  If your permit was issued from another municipality, you must file an application as a new resident.  If renewing a temporary (red) permit, the expiring permit must be returned with the application completed by physician indicating length of renewal time.

You may return the application to the address listed on the bottom of the application in person or by mail.  If coming in person, make sure to bring identification showing physical address for proof of residency.  The permit will be issued immediately. If mailing your application, provide a photocopy of your driver's license.  Mail is processed promptly, and you will receive your permit within a few days.

LOST OR STOLEN PERMITS
If your permit was lost or stolen, you must sign a sworn affidavit and have it notarized.  This affidavit must be submitted along with a $2.00 fee and a completed application, along with a photocopy of your driver's license.

DAMAGED OR ILLEGIBLE PERMITS
Permits that are damaged or illegible and need replacement must be returned to this office along with a $2.00 fee and a completed application with a copy of your driver's license.

LIQUOR LICENSES
Pursuant to NYState Alcoholic Beverage Control Laws, notification must be provided to the Town Clerk upon the filing of an application for a Liquor License with the NYS Liquor Authority.  The Town Clerk’s office will then furnish acknowledgement of said notification to all local Police Precincts.

A letter, sent certified mail and addressed to the Town Clerk must also be forwarded upon notification of the renewal of an existing liquor license.  The name and address of the establishment that will be serving the alcohol must be indicated.

SHELLFISH
Individual residents still may harvest up to one-half (1/2) bushel or 100 clams per day for their own use, in a prescribed manner, without a permit. Existing permits may be renewed on the 15th of February, annually.  A new permit may be filed on the 1st of March, annually. 

Requirements:  NYS Shellfish license and proof of residency, such as a telephone bill, electric bill, bank statement, drivers license, car registration, etc.  In the case you are a student attending school in the Town of Brookhaven a letter from the school to that effect will be accepted.  Two chauffeur size photos must be taken within 3 months of issuance of permit.

BIRTH REGISTRAR
This office issues and maintains birth and death certificates for unincorporated communities only.  Facilities under the Town of Brookhaven's jurisdiction are the Brookhaven Memorial Medical Center in East Patchogue and the University Hospital and Medical Center at Stony Brook.   If you were born in either John T. Mather Memorial Hospital or St. Charles Hospital, in Port Jefferson, following 1964, your birth record will be on file with the Port Jefferson Village Clerk.  Incorporated Villages have their own clerk and vital record offices.

There is a $10.00 fee per certified copy requested. Payment may be made in cash or by local check or money order made payable to "Brookhaven Town Clerk".

Birth records may be requested by the person named on the record if they are over the age of 18, their parents or a legal representative (with notarized authorization). Applicants should bring or mail the completed Application to Local Registrar for Copy of Birth Record form, along with proper identification (see application), proof of need, and the appropriate fee of $10.00 pre certified copy to Town Clerk's office.

DEATH REGISTRAR
Death records may be requested by the immediate family (spouse, children, parents) or when documented by a legal or medical need. Applicants should bring or mail the completed Applications to Local Registrar for Copy of Death Record form, along with proper identification, proof of relationship to the decedent, proof of need, and the appropriate $10.00 per certified copy fee to the Town Clerk's office.  Payment may be made in cash or by local check or money order made payable to "Brookhaven Town Clerk".

Searches of Birth, Death and Marriage Records for genealogical purposes are also performed by the Town Clerk's office. Birth records must be on file at least 75 years and Death and Marriage records must be on file at least 50 years to be eligible for a genealogy search. Uncertified copies only are provided and are clearly marked with the statement "For Genealogical Purposes Only".

Fee varies depending on requested number of years to be searched. Please refer to the form for the fee schedule as well as the rules set forth by New York State. These forms may be sent to the town or Albany at the address indicated on the form if you are not certain that the record exists in the Town.

MARRIAGE LICENSES
The Town Clerk is responsible for issuing a New York State Marriage License to qualified applicants, as well as recording the marriage with the New York State Department of Health. The marriage record is on file in this office and in Albany.

Licenses to marry in New York State may be obtained from the Town Clerk's office regardless of the residence of either of the parties. Once the license is issued, the ceremony may be performed anywhere in New York State.  The requirements for the issuance of marriage license in the Town of Brookhaven are mandated by the provisions of the New York State Domestic Relations Laws.

The marriage section of the Brookhaven Town Clerk's office is open Monday through Friday, 9 a.m. to 4:30 p.m. with extended hours on Monday’s until 7 PM.  Applicants should arrive a half-hour prior to closing. Both applicants must appear in person. Applicants must provide two forms of identification.  One must be a certified birth certificate, a certified baptismal certificate, from a church, or citizenship papers or naturalization papers.  In addition, the other must be one of the following forms of photo identification:  a valid driver's license, a valid Department of Motor Vehicle nondriver's I.D., a valid passport, valid United States military identification or valid green card.  Additional information may be requested.

If divorced, you must bring divorce papers from your most recent divorce and provide verbal information on how any other marriages ended.  Necessary information will be date of divorce, who initiated the action, and where the divorce was granted.

If the marriage ended due to the death of a spouse; a certified copy of a death certificate will be needed.

A $40.00 fee will be charged for the marriage license, payable by cash, local check or money order to the "Brookhaven Town Clerk.  A list of officials who perform marriage ceremonies will be provided upon request.

A certified "Transcript of Marriage" can be obtained by applying in person or by mail.  Applicants should bring or mail the completed application to the Town for a copy of their marriage record along with a photocopy of proper identification (valid driver’s license, valid non-drivers ID, valid Passport, or certified copy of a birth certificate), along with your return address and daytime telephone number and a fee of $10.00.  Payment may be made in cash or by local check or money order - payable to the "Brookhaven Town Clerk”.

BROOKHAVEN TOWN LICENSES

AMUSEMENTS
All Amusements Are Prohibited In Brookhaven Town Except Those Conducted Under The Sole Management And For The Profit Of Local Religious, Fraternal, Political, Educational, Veterans, Fireman, Civic, Non-Profit, Or Charitable Organizations When Authorized By A Permit Issued By The Town Clerk.

All Permit Applications Should Be Filed At Least Twenty (20) Days Prior To The Commencement Of Such Amusement

Any Event That Involves An Audience Capacity Of Attendees In Excess Of 1,000 Persons Must Be Filed At Least Sixty (60) Days Prior To The Commencement Of Such Event.

Pursuant To Part 18 of the New York State Sanitary Code, Any Public Function With An Estimated Peak Attendance Of 5,000 Or More Requires A New York State Permit For A Public Gathering.  Please Call Suffolk County Health Services {631-853-3130} For A Permit Application.

Time Limits: No More Than Fourteen (14) Days Duration.
Hours: Sunday Through Thursday - Not Before 9 am Nor After 10:30 pm
             Friday And Saturday - Not Before 9 Am Nor After 11:30 PM

BEACH BUGGY
Any person, firm, corporation or partnership may apply hereunder to the Town Clerk of the Town of Brookhaven for a permit to operate a motor vehicle on the Great South Beach. Such application shall state the reasons therefore, the intended use and the times of intended operation, The Town Clerk, in passing upon the application, shall consider whether or not the nature and extent of the intended use is consistent with the public health, safety and welfare and the rules and regulations governing the Fire Island National Seashore. The Town Clerk may grant the application, deny the application or grant the application with limitations and restrictions.  Applicant must be a resident of or working on Fire Island with contract showing the current date of employment, a corresponding sticker will be applied to vehicle.

An application for a permit to operate a motor vehicle on the Great South Beach shall be made to the Town Clerk on a form to be provided by him. The applicant shall furnish the following information:

The name and address of the applicant's dwelling or residence.
Whether the permit applied for hereunder has ever been suspended or revoked and, if so, the circumstances thereof.

In the case of a school bus, the name and number of the school district.
The make, model and year of the vehicle for which the permit is sought and current registration number of said vehicle.

A statement that the operator is a duly licensed operator under the laws of the State of New York.

No motor vehicle may be operated upon the Great South Beach by any person unless a permit has been issued by the Town of Brookhaven for such use. No motor vehicle may be operated on the Great South Beach by any person who is not a duly licensed operator under the laws of the State of New York.

Fee:  $100.00

GAME ROOM
Applicant purchases kit and returns paperwork to Building Department.  Upon Building Department approval, applicant will receive applications and letter of approval to bring to Town Clerk’s office, along with two (2) chauffeur size photos of the operator.   Applicant will then be issued a device license and operator’s license with corresponding license numbers.

GAME ROOM - 4 OR MORE GAMES
Same procedure as above except Game Room also requires a special permit from the Zoning Board of Appeals.

SUPPLIER - OWNER OF DEVICES SUPPLYING MORE THAN 3 GAMES IN THE TOWN
Applicant must provide a listing to the Town Clerk’s Office of how many games he/she owns and where they are located.

Fee: $750.00

PARADES
No person, firm, corporation or other entity shall organize, conduct or take part in any parade upon any town highway, public street or any other public place in the Town of Brookhaven without a permit issued therefore by the Town Clerk. Such permit shall not be required for any funeral processions for the actual burial of the dead and processions to and from a place of worship in connection with a religious service there celebrated. The discharge of firearms or fireworks and the making of other unreasonable noise during funeral processions are prohibited.

All applications for permits issued shall be in writing, stating the purpose thereof, and shall be signed by the person applying for the permit therefore or, in the case of an organization, signed by an officer of such organization. Such application shall be submitted to the Town Clerk at least fifteen (15) days prior to the date such parade is to be held.

PIGEONS
Any person housing or harboring pigeons must obtain a permit from the Town Clerk. No permit shall be issued to any person convicted of a violation of §85-384.”Animals”, Subsection “D” Pigeons. With all applications for permits, the applicant must supply the following:

A statement that the applicant has not been convicted of a violation of this Section.
A survey or diagram showing the proposed location of said loft or house and its distance from said surrounding residences and property lines.
(b) Said permit must be renewed annually. {Permit expires annually, on the 31st of December}

MARINAS AND BOATING

Any resident who is the owner of a private pleasure boat shall be entitled to make application for a permit to tie, moor or dock said boat to the dockage facilities at a town marina. Such permits shall be issued in the order in which received by the Town Clerk or his designee and s/he shall assign the permit holder to a specific berth. In addition, the Town Clerk is hereby authorized to temporarily reassign berths as s/he deems necessary and/or appropriate. Renewals of summer permits from the prior summer season shall take priority over new applications. In the event that the next available berth cannot be occupied by the next applicant, the Town Clerk may pass over said applicant and assign the berth to the next following applicant on the list whose boat may be accommodated by that particular slip or, at the Town Clerk's discretion, may offer said slip simultaneously and in writing to the entire waiting list and issue said permit according to the order in which said wait list applicants responses are received.

APPLICATION
Such application shall be on the form furnished by the Town Clerk and shall set forth the registration number, if any, the name of the boat, the manufacturer's name, the overall length and beam of such boat for which the permit is applied, the date of such application, the name and address of the owner and the age of the owner. In the event that the United States Coast Guard documents the boat, a photocopy of the current documentation papers shall be supplied. The Town Clerk shall have the right to reject any application if the boat is not registered within the United States or documented by the Coast Guard.

Expiration. Such permit shall be effective on the second Saturday in May of each year and shall expire on the first Sunday in November of the year for which it is issued. Renewal applications must be filed on or before the date set by the Town Clerk. In the event that such application for renewal is not filed on or before said date, the slip shall be available to the next applicant in the order in which the applications for such permits are received. The Town Clerk shall have the right to vary the dates during which permits are valid, depending upon the state of repairs and readiness for occupancy of the town marinas.

SOUTH SHORE {COREY, SANDSPIT, FORGE RIVER} $41/ft. - $570.00 minimum

PEDDLER
PURSUANT TO CHAPTER 36 OF TOWN CODE
Applicants for a license to peddle, stationary site license or vehicle license or renewal shall file with the Town Clerk a verified application, upon a form supplied by the Town Clerk, which shall contain the following:

The name, address and telephone number of the applicant.
The applicant's place of residence for the past five (5) years.
The applicant's business or employer for the past five (5) years.
The applicant's age, height, weight, color of eyes, color of hair and place of birth.
Two (2) full-face photographs of the applicant taken within thirty (30) days of application and measuring one and one-half by one and one-half (1 1/2 x 1 1/2) inches.
Whether or not the applicant has ever been convicted of a felony, misdemeanor or violation of any municipal ordinance, except traffic violations, and, if so, the date, court, ordinance violated and sentence of the court.

Whether the applicant has been previously licensed in any occupation and, if so, when, where and for what period and, if such previous license was ever revoked, the date of revocation and the reason therefore.

The name and address of the person, firm or corporation the applicant represents or is employed by.
The particular business, trade or occupation for which the license is requested.
The manner or means of conveyance in which said business or trade or occupation shall be conducted.
If the application is for a license to handle food in any form, the applicant shall submit a valid permit issued by the Suffolk County Health Department indicating compliance with the provisions of the Suffolk County Public Health Local Law.

If the applicant requires the use of weighing and/or measuring devices, such application shall be accompanied by a certificate from the County Sealer of Weights and Measures certifying that all weighing and measuring devices to be used by the applicant have been examined and approved.
If the application involves use of a vehicle, proof of a valid New York Motor Vehicle Registration for the vehicle to be used.

If the application involves the use of a vehicle, proof that the applicant holds a valid New York State driver's license.

Proof that the applicant holds a New York State sales tax identification number.

In the event that any other license or permit shall be required by any other governmental agency in connection with the applicant's business, the same shall be produced by the applicant, and the Town Clerk shall duly note the same.

Any additional information as the Town Clerk shall deem necessary for the purpose of administering the provisions of this chapter.

In addition, if the application is for a stationary site license, the following information shall also be provided:

(a)  A description of the property, whether vacant or improved, upon which the stationary licensee wishes to locate his vehicle, including:

[1] The location of the site and adjacent roadway.
[2] A diagram of the proposed location, drawn to scale, which has been approved by the Planning Division, showing ingress, egress and parking on site, where appropriate, and the proposed location of the peddler on the site.
(b)  A lease with the property owner for the use of the property by the stationary licensee for peddling.
Proof of insurance for a minimum sum of one hundred thousand dollars ($100,000.) for personal injury and property damage suffered by any person as a result of the peddler's doing business pursuant to a license issued under this chapter.

A.  Any change in circumstances with regard to the information provided in the application or on the license shall be reported to the Town Clerk within thirty (30) days.
B.  Applications for stationary site licenses shall only be accepted and approved for those persons having a valid stationary peddlers license on the effective date of this amendment and for the location indicated thereon.

FEES:  Peddler's license $150.00 per year -  Vehicle license: $200 per year per vehicle. Stationary site license $250 per year. {Said license and fee shall include use of one (1) vehicle} The annual fees herein provided shall be assessed on a yearly basis, and no annual fee shall be prorated or rebated. This license period is 7/1 to 6/30

WOODEN WALK PERMITS
(PURSUANT TO CHAPTER 83 OF THE TOWN CODE)
A.  The use of private vehicles shall be seasonally restricted as follows:

Between April 1 and October 31 of each year, no bicycle, self-propelled or motorized vehicle other than official government vehicles and those eligible for business use or special use permits, shall be operated upon or across any wooden public walk.

Between November 1 and March 30 of each year, bicycles, and self-propelled or motorized vehicles may be operated upon or across any wooden public walk.
No bicycle, self-propelled or motorized vehicle shall at anytime be used for the transportation of the public, either for hire or not.

B. Exceptions

Bicycles, self-propelled and/or motorized vehicles used for business purposes other than official government vehicles, may be operated upon or across any wooden public walk when authorized by a business use permit issued by the Town Clerk, subject to the following:

a) Upon application therefore to the Town Clerk in such form as said Clerk shall prescribe;
b) Proof of adequate liability insurance, the limits of which shall be determined by said Clerk or the Town Board;
c)Payment of a fee as prescribed by the Town Board.

Electrically powered golf or similar type carts solely for the transport of persons with special needs on account of a handicapping condition(s) may be operated by a bona fide chartered home owner association(s) upon or across any wooden public walk when authorized by a special use permit issued by the Town Clerk, subject to the following:

a) Upon application therefore to the Town Clerk in such form as said Clerk shall prescribe;
b) Proof of adequate liability insurance, as set forth in this Chapter;
c) Payment of a fee as prescribed by the Town Board.

C. All vehicles permits authorized by this section shall be valid from the date of issuance through December 31 of the same year.

D. All vehicles authorized by a permit as provided hereinabove shall prominently display the authorizing permit for such vehicle and an identifying name or logo, legible at a distance of at least fifteen (15) feet.

Between April 1 and October 31 of each year, no bicycle or self-propelled or motorized vehicle, other than official governmental vehicles, shall be operated upon or across any wooden public walk within the Town of Brookhaven between the hours of 7:00 p.m. and 7:00 a.m. of the following day.

FEE:   $100.00 per vehicle (golf cart, bicycle, wagon), for business use only.  Maximum width 48” (4 ft), Maximum weight 1800 lbs.

NYS DECALS
The Town Clerk's office is now issuing New York State Department of Environmental Conservation Automated Licenses. These licenses consist of hunting, fishing, Big Game, Small Game, Sportsman, etc.

Licenses may be purchased during regular office business hours, Monday through Friday between the hours of 9 AM and 4:30 PM.
